GatePass.ai – Terms and Conditions

Welcome to GatePass.ai, an AI-powered digital gate pass and visitor management system designed to help apartments, gated communities, institutions, and organizations manage visitor entry and security operations efficiently.

These Terms and Conditions (“Terms”) govern the use of the GatePass.ai website, mobile application, and related services (collectively referred to as the “Platform”).

By accessing or using the GatePass.ai Platform, you acknowledge that you have read, understood, and agreed to comply with these Terms. If you do not agree with these Terms, you must discontinue the use of the Platform immediately.

GatePass.ai is developed and operated by Krishik IT Services LLP.

1. Definitions

For the purposes of these Terms:

“User” refers to any individual or organization accessing or using GatePass.ai, including residents, visitors, security guards, administrators, RWAs, staff members, or institutional users.

“Community” refers to any housing society, apartment complex, residential association, school, office campus, factory, or institution registered on the GatePass.ai Platform.

“Platform” refers to the GatePass.ai mobile application, website, and associated digital services.

“We,” “Us,” or “GatePass.ai” refers to the operators and administrators of the GatePass.ai visitor management platform.

2. Eligibility

To access or use the GatePass.ai Platform, you must:

• Be at least 18 years old and legally capable of entering into a contract under Indian law.
• Be authorized by your respective Resident Welfare Association (RWA), institution, or organization, where applicable.
• Ensure that minors or junior residents use the platform only under the supervision of a responsible adult.

If you are accessing GatePass.ai on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

3. User Accounts

Certain features of GatePass.ai may require users to create an account and provide accurate personal information.

Users agree to:

• Provide accurate and up-to-date information during registration.
• Maintain the confidentiality of login credentials and account details.
• Accept responsibility for all activities conducted through their account.

GatePass.ai shall not be responsible for losses or damages resulting from unauthorized use of user accounts.

4. Services Provided by GatePass.ai

GatePass.ai provides digital visitor management and community security tools designed to simplify entry management and improve operational efficiency in residential and institutional environments.

Core services include:

• Digital visitor entry and approval system
• Resident and staff directories
• Daily help and staff attendance tracking
• Delivery and vehicle entry management
• Material and goods gate pass management
• Emergency alerts and broadcast notifications

GatePass.ai may add, modify, or discontinue features from time to time in order to improve service quality and enhance user experience.

5. Data Privacy and User Consent

GatePass.ai collects limited information necessary to ensure community security and operational management.

This may include:

• Name and contact details
• Apartment, flat, or office identification
• Visitor information and entry logs
• Security and access records

GatePass.ai complies with applicable Indian data protection laws, including the Digital Personal Data Protection Act (DPDP), 2023.

Communities, RWAs, or institutions using the platform are responsible for obtaining appropriate user consent before uploading or sharing personal information.

6. User Responsibilities

By using the GatePass.ai Platform, users agree to:

• Use the platform lawfully and responsibly.
• Maintain accurate profile information.
• Respect the privacy of other users.
• Avoid sharing sensitive data without authorization.
• Refrain from hacking, reverse-engineering, or disrupting the platform or its infrastructure.

GatePass.ai reserves the right to suspend or terminate accounts that violate these responsibilities.

7. Fees and Payments

Most features of GatePass.ai are free for residents and individual users.

Certain advanced features may be available through paid subscriptions for RWAs, institutions, or organizations.

Where applicable:

• All pricing will be transparent and clearly communicated.
• Payments will be processed through secure digital payment gateways.
• Applicable invoices or subscription terms will be provided.

8. Third-Party Integrations

GatePass.ai may integrate with trusted third-party service providers to improve functionality.

These may include services such as:

• payment gateways
• SMS or communication APIs
• hardware access systems

Examples may include providers like Razorpay or Twilio.

While GatePass.ai ensures secure integration, we are not responsible for the privacy policies or practices of external platforms once users are redirected to them.

9. Account Termination and Deactivation

Users may deactivate their GatePass.ai accounts at any time through the platform or by submitting a written request.

• RWAs or community administrators may revoke access for users within their community.
• GatePass.ai may suspend or terminate accounts that violate these Terms.

After account termination, access to the platform will cease. However, certain data may be retained for legal, compliance, or security purposes.

10. Prohibited Use

• Reproduce, copy, distribute, or resell any part of the GatePass.ai platform without written permission.
• Use the platform in a way that harms its performance, reputation, or other users.

GatePass.ai reserves the right to modify, suspend, or discontinue services with prior notice.

11. Disclaimer and Limitation of Liability

The GatePass.ai Platform is provided “as is” and “as available.”

While we strive to maintain reliable service, we do not guarantee:

• uninterrupted operation
• error-free performance
• complete security in all circumstances

Communities and administrators remain responsible for ensuring proper user consent and compliance with local regulations.

GatePass.ai shall not be liable for indirect, incidental, or consequential damages, including security incidents, onsite disputes, or misuse of information.

Our total liability shall not exceed the amount paid for the specific service in question.

Nothing on the Platform should be interpreted as legal, professional, or security advice.

12. Indemnification

Users agree to indemnify and hold harmless GatePass.ai, its employees, affiliates, and partners against claims, damages, or losses arising from:

• misuse of the platform
• violation of these Terms
• infringement of the rights of others

13. Intellectual Property Rights

All intellectual property associated with GatePass.ai—including software code, designs, logos, trademarks, and content—remains the exclusive property of Krishik IT Services LLP.

Users may not copy, reproduce, or distribute any content without prior written consent.

14. Updates to These Terms

GatePass.ai may update these Terms periodically to reflect product improvements, legal requirements, or operational changes.

Users will be notified through the platform or website when updates occur. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
